Terms and Conditions

1. Introduction: This User Agreement constitutes the agreement between Sonoma Safety Services and you as a user who accesses or establishes a connection and purchases a product or service. You agree to abide by all of the provisions in this Agreement in order to remain an authorized user of the Services, and your use of the Services constitutes your agreement to abide by these provisions. Sonoma Safety Services reserves the right, in its sole discretion, to change any or all of the provisions of this Agreement at any time and will make the current Agreement available at this URL. Sonoma Safety Services further reserves the right, in its sole discretion, to restrict the use of the Service as well as suspend or revoke your rights to use the Services based on our belief that your use of the Services violates that permitted by this Agreement or applicable law. IF YOU DO NOT AGREE TO THE PROVISIONS OF THIS AGREEMENT OR ARE NOT SATISFIED WITH THE SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SERVICES.

The core safety program and forms have been developed to assist you with your health and safety program. All materials should be updated annually according to Cal-OSHA laws. Further, inspection forms and training guides must be tailored to reflect the specific exposures at your facility. We recommend that this model be tailored to your specific operations, and professional counsel should be consulted before any action or decision based upon this material is taken. This is especially important if you are in a collective bargaining situation, as this could impact your agreement.

Please note: An Injury and Illness Prevention Program is a legal requirement, and the law absolutely requires that it is implemented. If you present this program as yours, Cal-OSHA will expect you to implement it. This means that the inspections, the training, the investigations, the communications, etc. must all be conducted in a thorough, timely manner. If you have a program that you do not implement, this could compromise your legal defense in the event of citations or fines or other legal actions.

2. Prohibited uses: Limited License. The materials provided are single site and are for your internal use only. Posting the Sonoma Safety Services materials on the internet or your intranet is prohibited. The Sonoma Safety Services web site and the services offered on or through our Web Site, including any content and materials thereon, are only for your personal, non-commercial use. You agree not to use the Services for any unlawful purpose. We reserve the right to terminate or restrict your access to a Service if, in our opinion, your use of the Service may violate any laws, regulations or rulings, infringe upon another person's rights or violate the terms of this Agreement.

3. Price, term and termination: The price you pay for a Service is stipulated at the time you enroll in such Service, free, single purchase or subscription. Subscription purchases are valid for the initial period for which you enrolled in the Service. Sonoma Safety Services reserves the right to change the price paid for a monthly or annual subscription after the initial enrollment period. Unless other arrangements have been made directly with Sonoma Safety Services, MONTHLY AND YEARLY SUBSCRIPTIONS TO THE SERVICE ARE ON A CONTINUOUS RENEWAL BASIS. This means your subscription will automatically renew every month on your monthly enrollment anniversary or the last day of the month if you enrolled on the 29th, 30th or 31st and the current month has no such date. For annual subscriptions, this means every year on your annual enrollment anniversary. We will notify you of new annual subscription. Your credit charge or other form of payment will be automatically charged or debited unless you have notified Sonoma Safety Services that you wish to cancel the Service. Your subscription renewal will be at the then current price charged for the Service. YOU MUST CANCEL PRIOR TO YOUR SUBSCRIPTION RENEWAL DATE TO AVOID CONTINUED CHARGES.

4. Disclaimer of Warranties & Limitation of Liability

4.1 YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. NEITHER SONOMA SAFETY SERVICES NOR ANY OF ITS EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD PARTY PROVIDERS, OR LICENSORS WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THEY WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, OR AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR CONTENTS OF ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE, ANY MERCHANDISE OR SERVICES PROVIDED THROUGH THE SERVICES, OR ANY LINKS TO OTHER SITES OR SERVICES MADE AVAILABLE ON THE SERVICES.

4.2 THE SERVICES, ALL TOOLS, CONTENT, MATERIAL, INFORMATION, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

4.3 UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL SONOMA SAFETY SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES ON THE SERVICE, OR THE SERVICE ITSELF. THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE PARTY LIABLE OR ALLEGEDLY LIABLE WAS ADVISED, HAD OTHER REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT SONOMA SAFETY SERVICES (AND ANY OF ITS EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD PARTY PROVIDERS IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER, INCLUDING YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF Sonoma Safety Services (OR ANY OF ITS EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD PARTY PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS) TO YOU EXCEED THE AMOUNT PAID BY YOU TO SONOMA SAFETY SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO ANY CLAIM OF INJURY OR DAMAGE.

5. Indemnification: To the maximum extent permitted by applicable law, you will defend, indemnify and hold harmless Sonoma Safety Services (and any of its employees, agents, distributors, Third Party Providers, and licensors (and their respective directors, officers, employees, and agents) from and against all claims, liability, and expenses, including attorneys' fees and legal fees and costs, arising out of your use of the Service or your breach of any provision of this Agreement. Sonoma Safety Services reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You will cooperate as fully as reasonably required in the defense of any claim.

6. Third Party Content, Third-Party Providers, Advertising and Links: The Services may include a number of third party providers of content, technology and other features, including the opportunity for users of the Services to purchase goods or services from third parties ("Third Party Providers”). These are provided for your convenience and are not endorsements by Sonoma Safety Services. Neither Sonoma Safety Services nor such Third Party Providers make any warranty concerning content, technology, goods or services provided by such Third Party Providers. YOU AGREE THAT ANY RECOURSE FOR DISSATISFACTION OR PROBLEMS WITH THOSE GOODS OR SERVICES WILL BE SOUGHT FROM THE THIRD PARTY PROVIDERS DIRECTLY, NOT FROM SONOMA SAFETY SERVICES.

PRIVACY POLICY

Sonoma Safety Services is dedicated to protecting your privacy when using our Web site (the “Site”). Please read this policy to understand how we collect and use information gathered through the Site, and to understand your rights regarding these practices.

PERSONAL INFORMATION COLLECTION & USAGE: Sonoma Safety may collect personal information from you on a voluntary basis. Personal information may include name, email address, title, company, address, phone number and similar information that identifies you. We collect this information so that you may obtain access to members-only portions of the Site and/or in order to receive our products and services. AGGREGATE INFORMATION COLLECTION & USAGE: We may collect information from visitors to our Site and users of our services in an aggregate, anonymous form, which means that the information will not contain nor be linked to any personal information. Sonoma Safety uses this information to measure the use of our Site and to improve the content of our Site. Aggregate information may also be compiled based upon personal information, such as zip codes. When this information is shared with a third party, it does not contain any personal information.

CLICKSTREAM: As you use the Web, a trail of electronic information is left at each Web site you visit. This information, which is sometimes referred to as "clickstream data," can be collected and stored by a Web site's server. Clickstream data can tell us the type of computer and browsing software you use and the address of the web site from which you linked to the Web site. Clear gifs (aka Action Tags) are being used to collect the clickstream data. This technology is also being used within html emails for the purpose of tracking open rates. We may use clickstream data as a form of aggregate information to anonymously determine how much time visitors spend on each page of the Site, how visitors navigate throughout the Site and how we may tailor our Web pages to better meet the needs of visitors. We attempt to provide for the secure transmission of your information from your computer to our servers by utilizing encryption software. We have put in place physical, electronic, and managerial procedures to safeguard the information we collect. Only those employees who need access to your information in order to perform their duties are allowed access to your personal information. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and Sonoma Safety Services will be free from unauthorized access by third parties such as hackers, and your use of the Site demonstrates your assumption of this risk.

WEB SITE LEGAL DISCLAIMER: Use of the Site is governed by the provisions contained in the Terms of Use that may be referenced therein. Your use, or access, of the Site constitutes your agreement to be bound by all of these provisions. Though we make reasonable efforts to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such an action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.

REFUND POLICY

  1. The cost of the core program will not be refunded. Please note that the retail program is not designed for Building Materials, and that the Restaurant program is not a HAACP program.

    Should you decide to discontinue receiving the “Safety Matters” monthly update, you may contact us anytime. Your subscription will be immediately cancelled. Future payments will be stopped and you will be refunded the value of any issues for which you have paid, but have not received.

  2. Training. Cancellation charges of $50.00/person will be imposed for cancellations within two weeks of the training date. If training is arranged for a dedicated group, cancellation charges will include the cost of the rental facility, if any, and will match their cancellation policies. These terms will be clarified at time of scheduling the class.
